Appeal Court reserves judgment in Aregbesola, Oyinlola’s case

The Court of Appeal, Ibadan on Monday reserved judgment in the appeal filed by the governorship candidate of the Action Congress of Nigeria in Osun State in the 2007 election, Mr. Rauf Aregbesola.

Aregbesola is appealing against the verdict of the state election petition tribunal that upheld the Independent National Electoral Commission’s declaration of the state Governor, Prince Olagunsoye Oyinlola, as the winner of the April 14, 2007 governorship election in the state.

The five-man panel headed by Justice Clara Ogunbiyi reserved judgment on the appeal after listening to the counsel to the parties adopting their briefs.

Other members of the panel are Justices M.L. Garba, P.A Galinge, C.C. Nweze and A. Jauro.

In adopting his brief, one of the lawyers that represented Aregbesola, his running mate and the ACN, Chief Akin Olujinmi (SAN), called the attention of the court to the fact that even though the INEC filed a reply denying allegation of irregularities during the election, the electoral body elected not to call any witness to challenge any aspect of the evidence tendered.
