ACN loses bid to stop Kwara LG poll

A Federal High Court in Ilorin on Tuesday struck out a suit by the Action Congress of Nigeria seeking to stop the Kwara State Independent Electoral Commission from conducting the local council elections scheduled for October 30.

The applicants had prayed the court to restrain KWSIEC from conducting elections into the 16 local government councils of the state on the grounds that the current voter register was invalid.

Joined as defendants in the suit were the All Nigeria People’s Party; Accord Party; Peoples Democratic Party; and the Congress for Progressive Change.

In his ruling, Justice Olayinka Faji said in treating the case, the court has to look at the two preliminary objections filed by the defendants which border on the constitutional right of the court to hear the suit.

He said, “The issue of jurisdiction is intermingled with misjoinder of parties. The claim against INEC is purely academic as the courts in Nigeria do not have an advisory role.”
