Osun appeal tribunal, no cause for alarm - Oyinlola


THE legal team of the Osun State Governor, Prince Olagunsoye Oyinlola at the Election Petition Tribunal, declared that there was no cause for alarm.
The  assurance of the  legal team came as a reaction to the media report by a national newspaper that the Election Appeal Tribunal was peopled by those believed to have sympathy for the Action Congress of Nigeria (ACN) and other relationship with the leladership of the ACN may tilt the judgement in favour of the ACN candidate, Alhaji Rauf Aregbesola.
The team  said it is eagerly awaiting the composition of the five man panel of the court that would hear the case which is due for hearing on November 3, 2010.
Speaking with newsmen in Ibadan, two members of the legal team of the governor, Chief Bolaji Ayorinde, SAN, and Otunba Kunle Kalejaye, SAN said although the five-member panel that would hear the case had not been named, the Oyinlola team led by Mallam Yusuf Ali, SAN was “set for action.”
They explained further that members of the three-man panel headed by Justice Kudirat Kekere-Ekun which considered an application brought by one of the parties in the case on Tuesday were the regular Ibadan Division Justices of the Court of Appeal.
Specifically, they explained that the law stipulates a full court of five Justices of the Court of Appeal to hear governorship election appeals while the tradition had been that Justices who serve in such panels are always drawn from outside the division where the case is being heard.
It will be recalled that a three-man panel of the Court of Appeal in Ibadan headed by Justice S. S. Alagoa on Monday, October 4, 2010 heard an application by the INEC for an extension of time to file its briefs while another three-man panel of the court headed by Justice Kudirat Kekere-Ekun heard a similar application by the Police on Tuesday, October 20, 2010.
