life without Limbs"--("No Arms , No Legs, No Worries")

Nick Vujicic (born December 4, 1982) is a preacher, a motivational speaker and the director of Life Without Limbs, an organization for the physically disabled. He regularly gives speeches across subject of disability and hope.
Early life The first-born child in his devout Serbian Christian family, Vujicic was born in Melbourne, Australia with the rare Tetra-amelia disorder: limbless, missing both arms at shoulder level, and legless but with two small feet, one of which has two toes. Initially, his parents were devastated. Vujicic was otherwise healthy.
Growing up
His life was filled with difficulties and hardships. One was being prohibited by Australian law from attending a mainstream school because of his physical disability, even though he was not mentally impaired. During his schooling, the laws were changed, and Vujicic was one of the first disabled students to be integrated into a mainstream school. He learned to write using the two toes on his left "foot", and a special device that slid onto his big toe which he uses to grip. He also learned to use a computer and type using the "heel and toe" method (as demonstrated in his speeches), throw tennis balls, answer the phone, shave and get himself a glass of water (also demonstrated in speeches).
Epiphany

Being bullied at his school, Vujicic grew extremely depressed, and by the age of 10, started contemplating suicide. After begging God to grow arms and legs, Nick eventually began to realize that his accomplishments were inspirational to many, and began to thank God for being alive. A key turning point in his life was when his mother showed him a newspaper article about a man dealing with a severe disability. This led him to realize he wasn't the only one with major struggles. When he was seventeen, he started to give talks at his prayer group, and eventually started his non-profit organization, Life Without Limbs.
Career
Nick graduated from college at the age of 21 with a double major in Accounting and Financial Planning. He began his travels as a motivational speaker, focusing on the topics that today's teenagers face. He also speaks in the corporate sector, although his aim is to become an international inspirational speaker, in both Christian and non-Christian venues. He regularly travels internationally to speak to Christian congregations, schools, and corporate meetings. He has spoken to over two million people so far, in twelve countries on four continents (Africa, Asia, Australia, and North America).

I did not mastermind bribery scandal – Jonathan


President Goodluck Jonathan on Thursday said there was no truth in widespread insinuation that his government was orchestrating the $620,000 bribery scandal involving the Chairman of the House of Representatives’ ad hoc committee on the fuel subsidy, Mr. Farouk Lawan, and an oil businessman, Mr. Femi Otedola.
Jonathan said this in a statement by his Special Adviser on Media and Publicity, Dr. Reuben Abati, in Abuja.
The President’s aide described the insinuation that the scandal was a ploy by Jonathan and the executive arm of government to unseat the leadership of the House as “lame, diversionary, totally false and baseless.”
Abati also told our correspondent in an exclusive interview that despite the bribery scandal, Jonathan would not stop the action he had already initiated on the implementation of the report of the committee.
The President said notwithstanding the development on the scandal, his directive to the Attorney-General of the Federation, Mr. Mohammed Adoke (SAN), on the report of the probe committee, as adopted by the House, had not changed.
He said that he expected that all those indicted in the report would be duly investigated and prosecuted if a prima facie case of misconduct was established against them.
The presidential statement reads, “The Presidency denounces the lame and diversionary attempt by some newspapers to drag the person and office of the President into the very unsavoury bribery scandal involving the Chairman of the House of Representatives’ Fuel Subsidy Probe Ad Hoc Committee and a well-known petroleum products marketer.
“The mischievous insinuation in today’s editions of the newspapers that the entire affair, in which the two key players have publicly confessed their roles, is part of a plot by President Goodluck Jonathan and the executive arm of government to unseat the leadership of the House of Representatives, is totally false and baseless.
“For the benefit of unwary members of the public who may be deceived by the political innuendoes now being woven into the subsidy probe bribe affair, President Jonathan wishes to affirm that he has absolutely no reason or desire to meddle in the affairs of the House of Representatives and its leadership.
“Neither the President nor anyone acting on his request or order has anything to do with the scandal that has sadly engulfed the House ad hoc committee on fuel subsidy. The attempt to drag the Presidency into the matter is entirely speculative and without factual foundation.
“Against the background of its avowed commitment to the effective prosecution of the war against corruption in Nigeria, the Presidency notes with satisfaction that given the seriousness of the scandal, the House of Representatives has already recalled its members from recess for a special session to deliberate on it tomorrow.”
The House on Wednesday sent notice out to its members to report for an emergency session on Friday (today). Though the notice sent by the Clerk of the House, Mohammed Sani-Omolori, did not specify the agenda for the session, some members had told The PUNCH that the bribery scandal would be the main subject for debate.
The fear has been expressed in some quarters that the bribery scandal currently rocking the probe panel would make Jonathan to push aside the document without proper implementation.
But Abati said such fear was unnecessary as the President had not issued any other directive to invalidate the earlier one handed down to the AGF.
He said as far as the President was concerned, both the bribery allegation and the report of the ad hoc committee were currently before security agencies who he believed would do a thorough job on both.
“When the President received the report of the House of Representatives’ ad hoc committee, he made a presidential directive. Has that directive been changed?
“That directive has not been changed. Both the bribery allegation and the report are before security agencies and they will do a thorough job on both of them,” Abati said.

PDP power brokers move against Tambuwal

Facts emerged in Abuja on Wednesday that the leadership of the Peoples Democratic Party was instrumental to the exposure of the $620,000 bribery scandal currently rocking the House of Representatives.
Investigations by our correspondents showed that the party was aware of the bribe from the initial stage and agreed to the deal.
It was gathered that the PDP was targeting the Speaker of the House, Mr. Aminu Tambuwal, for removal because of the belief that he was too “independent for the party leaders.”
Sources within the top echelon of the party informed our correspondent that members of the committee probing the fuel subsidy payment met with the party’s leadership and they agreed that the investigators should soft pedal on those they said were financers of the party, who also benefited from the subsidy payment regime.
The committee members, led by their chairman, Mr. Farouk Lawan, were said to have been persuaded not to indict these influential members in their report.
Before arriving at this, it was learnt that the leadership of the party had asked the committee to suspend its sitting or stop the probe entirely.
But when it was apparent that the committee members would not allow that because of the pressure from the public and the leadership of the House, the two parties were said to have agreed that the major oil marketers would not be indicted.
A top member of the party said, “We agreed that the money be given to them for logistics as they claimed. We agreed that the committee members should not be hard on the major marketers in their report.
“This is because the party produced these members of the committee. Without our slot, will they be able to be at the National Assembly?
“There is no way that a ruling party will not have a say in the running of the House, especially when its leaders are members of the party.”
The source added that the party was astonished when the report of the committee was released and almost everyone was indicted.
This, the source said, was contrary to the agreement the party had with the committee members, led by Lawan.
He said they recorded the transaction because the party’s leadership suspected that the committee members could renege on their promise.
The source said if the committee members had agreed to the deal, it was possible the deal would not had been made public “now.”
Asked why Lawan was not arrested by security agents at the point of collecting the money, he said there might not be any prove to show that the money paid Lawan actually came from the security agencies.
He said the party’s leadership and the Presidency were further angered when Tambuwal, at the first anniversary of the President Jonathan administration at the Presidential Villa, accused the President of not signing bills presented to him by the National Assembly.
According to our source, exposing the bribe would attract public ridicule for the entire leadership of the House.
“We expect the public to call for the resignation of the Speaker and the entire leadership,” the source added.
Meanwhile, legal practitioners, under the aegis of Public Interest Lawyers League, have demanded the resignation of the Speaker of Tabuwal.
They also demanded the questioning of oil magnate, Mr. Femi Otedola, to determine his level of complicity in the saga.
President of the group, Mr. Abdul Mahmud, said this at a press conference in Abuja, on Wednesday.
However, another group, the Civil Society Legislative Advocacy Centre, has raised the alarm over a plot to use the fuel subsidy bribery scandal to remove Tambuwal.
A statement by CISLAC’s Executive Director, Auwal Musa in Abuja, on Wednesday alleged that the executive and some oil thieves were involved in the plot.
It said the two had never been comfortable with Tambuwal’s style of leadership.
In a related development, elder statesman and former Federal Information Minister, Chief Edwin Clark, on Wednesday called for the immediate arrest and prosecution of Lawan and Mr. Femi Otedola over their involvement in the $3m scam.
The Ijaw leader also called for a total overhaul of the way the Federal House of Assembly is currently run, saying the activities of the house had become a shame to the nation.
Clark, who spoke in his Kiagbodo home, Burutu Local Government, Delta State, maintained that the two chambers of the National Assembly, by their actions, had shown that they could not be trusted to make laws for the good governance of the country.

DANA AIR CRASH: Govs, senators, ministers, others lament


 WORDS of condolence, commiseration and comfort poured forth from prominent Nigerians and aviation stakeholders, yesterday, as news of the crash of the Dana Air plane settled on the country.

Many of those who reacted last night said it was an irony that the crash happened at a time that it was believed that the problems that had for long bedeviled the aviation sector were about being overcome.
President of the Senate, Senator David Mark, Speaker Aminu Tambuwal, Deputy President of the Senate, Senator Ike Ekweremadu, governors, Aviation Minister Stella Oduah and national chairman of the Peoples Democratic Party, PDP, Alhaji Bamanga Tukur were among those who reacted last night.
While commiserating with families of the victims, Senator Mark promised that the Senate would investigate the cause of the aircrash in a bid to ensure that there is no recurrence.
Mourning loss of lives
In a statement issued on his behalf by his Special Adviser on Media, Mr. Kola Ologbondinyan, Mark said: “I feel so sad and heartbroken hearing the news of this ugly incident. It is quite unfortunate and disheartening. We mourn the loss of lives and prayed God to put a stop to every form of evil in our land. The Senate will definitely investigate the cause of this ugly incident to checkmate any future occurrence.”
Speaker Tambuwal who said he received news of the crash with great shock and sadness, said the unfortunate incident came at a time Nigeria made giant strides in the area of aviation safety. In a statement by his Special Adviser on Media, Imam Imam, the Speaker encouraged Nigerians not to be deterred from using air travel on account of yesterday’s crash.
Ekweremadu described the incident as “shocking and emotionally devastating,” noting: “This is shocking beyond words, especially given the noticeable efforts at repositioning the nation’s aviation industry and when we thought we had put the air disasters of early 2000s behind us.”
Aviation Minister, Princess Stella Odua who was on her way to the scene yesterday said: “I am extremely saddened by the news of the crash and I assure the nation that investigations are underway.”
Her predecessor, Mr. Femi Fani-Kayode on his part said: ”This is so sad. All that blood and life just wasted. We warned them about safety standards. Aviation is the sector I presided over. I know it inside out and now I am in pain. May the souls of those that died in that crash rest in peace.”
Lagos State Governor Babatunde Fashola said: “It is unfortunate that your expectations to welcome and embrace your loved ones after their journey could be cut short so abruptly and in such unexpected manner. There is no gainsaying the experience could be traumatic,” regretting that the incident would destabilize homes as well as cause disruption to the lives of the affected families.
Governor Adams Oshiomhole of Edo State has described the death of over 150 people in a plane crash at Iju, in Lagos as a great loss to the nation. In a statement by his Chief Press Secretary, Mr Peter Okhiria, the Governor said: “I received with great shock news of the plane crash at Iju, in Lagos, in which over 150 people lost their lives. I wish to convey the deepest condolence of the people and Government of Edo State as well as my personal commiseration to the families of the victims.”
Governor Abdulfatah Ahmed of Kwara State described the crash as unfortunate and national disaster of monumental proportions. He advised aviation authorities to stop at nothing in finding out the caused of the Iju plane crash in order to avert future occurrence, prayed God to grant families of the victims of the two unfortunate incidents the fortitude to bear the loss.
Governor Idris Wada of Kogi State described the crash as a major loss and a sad day in the country’s history. Wada himself a pilot while sympathizing with the families of the victims commended those who were on hand to lend a helping hand at the crash site.
Chairman, Senate Committee on Aviation, Senator Hope Uzodimma on his part expressed shock over the crash and lamented that it occurred at a time when the Federal Government had put in place the necessary machinery to turn around the aviation industry.He called for an immediate probe into the air accident by the necessary authorities in the aviation ministry with a view to unearthing the cause and averting future occurrence.While commiserating with families of the victims, the senator expressed the resolve of his committee to put in place laws that would guarantee the safety of air travelers in Nigeria.
The PDP in a statement issued by its national publicity secretary, Chief Olisa Metuh on behalf of Tukur condoled with President Goodluck Jonathan and families of the victims over the incident. He said: “The entire members of our Party share in the grief, the pain and the anguish of the families of those who have lost their loved ones, their confidants, their sisters and brothers; their fathers and mothers; breadwinners and employers; and all those who are affected by this national calamity.”
“We (all Nigerians)are united in our grief and our condolences go to you all as we pray that Almighty God will in His infinite mercy and compassion console and comfort you at this most trying period of your life and give the bereaved families the fortitude to bear their irreparable loss.”
The Southwest chapter of the PDP also spoke in the same vein describing the crash as sad and painful.In a statement issued by its Zonal Publicity Secretary, Hon. Kayode Babade, the PDP commiserated with President Goodluck Jonathan, minister of aviation, governors and government of Lagos and Ogun states, management of DANA Airline, the entire Nigerians, especially those who lost their relatives in the crash.”
This is very sad and painful and all that we can say is that God in His mercies will console those who lost their relations in the crash,” PDP said.

Lagos State Governor Babatunde Fashola on Tuesday said his administration had reversed the sacking of 34 doctors out of the 788 dismissed recently.
He urged the remaining doctors to end the logjam in the health sector by emulating their colleagues and appealing to the Health Service Commission, since their reinstatement was still possible.
Fashola explained that the doctors were recalled because of their appeal and positive review of their cases.
The governor spoke during a panel discussion aired live on the state television station, LTV, to commemorate his 5th anniversary in office.
He said he could not order the reversal of the sacking because it was not his own making. He explained that his powers as governor of the state did not give him power to sack or employ any doctor.
Fashola pointed out that the HSC was the body saddled with the responsibility of determining the fate of the doctors.
He said, “It is not in my power to reverse the sacking, just as I cannot determine their promotion. It is the HMC that will promote them and since I won’t be here after three years, it is better to allow procedure to take its course. It is not about me, it is about institutions.”
He however said he was still making efforts to ensure a final resolution of the crisis, adding that any doctor that appealed stood a good chance of being recalled.
The governor denied that the government reneged on its agreement with the doctors, saying the state had made efforts to ensure that doctors were comfortable.
He, however, noted that instead of incessant calls for increment by workers, the focus should be on solution to institutional imbalance and factors that weaken the currency.
He said the state government was tackling some of the problems by initiating projects to promote welfare in agriculture; housing and inter modal transportation.
The governor later inaugurated State Traffic Radio, 96.1 FM, as part of the celebration, saying that traffic information would ensure safe motoring in the state and a healthy life for its citizens.
Fashola also inaugurated a new BRT route to cover Yaba-Oyingbo-Iddo, saying it would provide sustainable mass transit services in the state.

Power firms: Oando, Indian company, others to express interest

As the deadline for the expression of interest in the power generating and distribution companies unbundled from the Power Holding Company of Nigeria approaches, MARTIN AYANKOLA reports that renowned local and foreign firms are currently putting finishing touches to their bid documents.



A leading player in Nigeria’s energy industry, the Oando Group, and an Indian company, Essar, are at the forefront of the different consortia that are expected to express interest in the Federal Government’s power firms on February 18.

The Bureau of Public Enterprises has asked prospective investors to submit Expressions of Interest for eleven distribution companies, four power generating firms and two hydro power stations slated for privatisation.

A source at the Oando Group told our correspondent on Sunday, “We are going to show firm interest in some distribution companies and a power generation firm.

“We are leading a consortium that also includes a multinational power company. I cannot reveal the name of our partners to you now, but we are definitely expressing an interest.”

Another source at the Bureau of Public Enterprises also disclosed that Essar, the Indian power giant, was showing serious interest in the generation and distribution firms.

“I expect them to show firm interest in the companies. Some other foreign firms are also in discussion with Nigerian firms with a view to forming consortia to express interest and later bid for the power firms,” the source added.

The Oando source, who is a top official of the integrated energy company, said, “We are so far satisfied with what the government has done as regards sticking to the timetable for the privatisation of the sector.

“We think the government has shown commitment and seriousness so far and with the right political will, the process will be successful.”

He added, “However, the true level of government’s seriousness will be determined by what is done after the Expressions of Interest in the firms”.

A power analyst and Managing Director of Powercap Limited, Mr. Abiodun Ogunleye, also gave kudos to the Federal Government for implementing the privatisation timetable to the letter.

Ogunleye told our correspondent on the telephone on Sunday, “The Federal Government has been serious with the timetable. However, the issues we need to address relate to whether the time is long enough for serious investors to express interest and the need to ensure that the process is not hijacked by politicians.”

The BPE had also embarked on road shows since January 18, to woo investors to the Nigerian power industry, starting with a meeting with investors in Lagos.

Aside from the Lagos event, meetings had also been held with investors in Dubai, United Arab Emirates on January 24; London, United Kingdom, on January 27; and New York, United States on February 1; while another meeting will be held with investors in Johannesburg, South Africa, on February 11.

The spokesman for the BPE, Mr. Chukwuma Nwokoh, told our correspondent on the telephone on Sunday that over 200 individuals attended the London event.

“We also had over 90 people in attendance in Dubai,” he added.

Furthermore, the Federal Government has offered prospective investors a five-year tax holiday as part of incentives to woo them to the power sector.

According to the BPE, another incentive for investors is the World Bank’s instruments to insure their investments against political risks.

The agency also assured investors of a cost-reflective tariff regime and pledged to resolve all labour matters before the handover of the companies to the core investors.

The meetings with the investors are coming ahead of the February 18 deadline for the expression of interests in 11 distribution companies, five thermal generating firms and two hydropower stations.

Speaking at the Lagos event, the Director-General, BPE, Ms. Bola Onagoruwa, said, “The idea of this is that it enables investors to gain some confidence. Even if we don’t complete the privatisation before the handover of government, no harm is done.

“From the response you have seen here, power is something that has attracted the interest of most people in Nigeria. I don’t think any administration will come in and not take the issue of reforms in the power sector seriously.”

The eleven distribution companies, which investors are expected to express interest in, include the Abuja Electricity Distribution Company Plc; Benin Electricity Distribution Company Plc; Enugu Electricity Distribution Company Plc; Eko Electricity Distribution Company Plc; Ibadan Electricity Distribution Company Plc and Ikeja Electricity Distribution Company Plc.

Others are Jos Electricity Distribution Company Plc; Kaduna Electricity Distribution Company Plc; Kano Electricity Distribution Company Plc; Port Harcourt Electricity Distribution Company Plc and Yola Electricity Distribution Company Plc.

Investors are also expected to express interests in four thermal generating stations, namely: Ughelli Power Plc; Geregu Power Plc; Afam Power Plc; and Sapele Power Plc.

Two hydro power stations; Kainji Power Plc, including the Jebba power station, and Shiroro Power Plc, will be given out to private investors under a concession arrangement.

Also, speaking at the forum, the Minister of State for Power, Mr. Nuhu Wya, said that both local and international investors were invited to the forum to show the numerous opportunities available in Nigeria’s power sector.

According to him, the forum is also to share with investors, the precise details of the Federal Government’s privatisation plans and strategies for the divestiture of PHCN successor companies and other assets.

He said, “Altogether, these assets deliver about 4,000 megawatts today. The Vision 2020 envisages a market for 40,000MW in 10 years’ time; that is, by 2020.

“This growth, which is quite plausible, has to be driven by Greenfield private sector investments. Our mission in this forum is to have a better understanding of your concerns so that we can build a power supply industry that works for all and grows fast enough to cope with demand.”

The Chairman, Presidential Task Force on Power, Prof. Barth Nnaji, also told our correspondent on the telephone that the response of prospective investors to the road shows had been impressive.

April elections and season of litigations

Against the backdrop of cases arising from party primaries, FRIDAY OLOKOR examines fears of stakeholders and warns that litigation is a threat to the forthcoming elections.





If there is any legacy, which the present political dispensation has enjoyed most, it is the implicit faith in the judiciary. The judiciary, from recent developments, especially the 2007 general elections, has proved to be a potent force to be reckoned with in the nation’s politics. Although the judiciary was said have corrected many of the injustices during the elections, which were described by international observers as the worst in Nigeria’s political history, the sins of the then Chairman of the Independent National Electoral Commission, Prof. Maurice Iwu, during the elections, will forever remain.

As the nation marches to another general election, politicians are at it again. The courts have of recent been inundated with cases arising from the primaries. Analysts have, however, warned that unless stringent steps are taken, litigation could be an obstacle to forthcoming elections. From Kogi, Enugu, Imo to Oyo, Ogun, Kano and Yobe states, it is the same story.

Only recently, Justice Abdul Kafarati of a Federal High Court in Abuja stopped the Peoples Democratic Party from conducting another primary election into the Kogi Central Senatorial District. He gave the order following a motion ex parte by the Special Adviser to the Speaker of the House of Representatives (Political Matters), Mr. Nurudeen Abatemi-Usman, against the PDP and INEC.

In the PDP primary election for Kogi Central Senatorial District, the plaintiff was said to have defeated an incumbent senator, a local government chairman and eight others.

The plaintiff had, in the suit by his lawyer, Mr. Patrick Ikwueto (SAN), proceeded to court seeking, “an order of interim injunction restraining the defendants and their agents from conducting, organising or monitoring/supervising the holding of another senatorial primary election for Kogi Central Senatorial district, pending the determination of the motion on notice.”

Luck smiled on Usman when he was declared by Kafarati as the legitimate winner of the PDP Kogi Central Senatorial primary election. The judge held that there were concrete evidence that the Kogi Central Senatorial primaries took place and was conclusive.

Also in Kogi State, a Federal High Court in Abuja has stated that the PDP may not have a governorship candidate for the April 5 election, unless it reverses the earlier order for a rerun primary election. The PDP had submitted the name of a former Executive Director of Afribank Plc, Mr. Jibrin Isah, as its governorship candidate. In a motion ex parte, a runner-up in the cancelled election, Mr. Abdulrasak Kutepa, sought an order to stop Isah’s nomination. Justice Gabriel Kolawole summoned INEC to come and show within 72 hours, why the reliefs sought by Kutepa should not be granted, while ordering the plaintiff to serve the court processes on the PDP and INEC who are co-defendants in the matter.

Kutepa had in his exparte application prayed for an order restraining PDP from nominating Isah as its governorship candidate in the state for the April election, arguing that the primary election which produced him had been nullified by the Appeal Panel of the party, that reviewed the primary election conducted on January 9.

Justice Kolawole had noted in the earlier part of his ruling that Kutepa approached the court because the rerun election ordered by the party did not hold on January 25 as scheduled.

In Ogun State, Justice Kafarati also restrained INEC and the PDP from accepting the list of candidates sent by the dissolved Ogun State Executive Committee led by Chief Joju Fadairo.

This order was sequel to an ex parte application by Chief Adetunji Olurin, Babatunde Fadun, Tunde Oladunjoye, Mr. Dave Salako, Mr. Wale Solaja and Seun Adesanya.

The motion was supported by a 53- paragraph affidavit sworn to by Wale Solaja and moved by Mr. O.O. Fakunle (SAN).

The judge ordered thus: “That the first (INEC) and second (PDP) respondents are restrained from accepting, compiling, announcing, using, validating or otherwise acting upon the results of the primaries/congresses conducted in Ogun State pending the hearing of the originating summons.

In Kano State, a son of late Gen. Sani Abacha, Mohammed, is at the Federal High Court in Abuja where he is praying the court to declare him winner of the Congress for Progressive Change governorship primary in the state.

In an originating summons filed by his lawyer, Mr. Abdullahi Haruna, the plaintiff wants the court to declare that INEC should not recognise any other candidate for the said election other than him.

Citing his grounds for the relief, Mohammed stated that he scored the highest member votes of 144,066 in the party’s governorship primaries above the other four candidates, who contested against him.

He joined CPC, INEC, Brig.-Gen. Lawal Isah (retd.), and the party’s chairman, Board of Trustees, Maj.-Gen. Muhammadu Buhari (retd.) as Co-defendants in the suit.

Besides, Mohammed asked the court to declare that the failure of CPC to submit his name to INEC as the duly elected candidate of the party for the April polls was a clear breach of the party’s constitution and should therefore, be reversed in the interest of justice and fairplay.

According to him, the primary election conducted on January 12 saw Senator Rufai Hanga scoring 45,618 votes; Dr. Awalu Anwar (30,410) and Mr. Magaji Abdullahi (5,795).

In Yobe State, three chieftains of the PDP: Ali Danladi, Mohammed A. Mohammed and Mohammed Bako have also gone to court to seek an order restraining the party from submitting the name of Usman Al-Bashir to INEC, as the governorship candidate of the PDP because he still has a case to answer in the Supreme court.

The plaintiffs have asked the Federal High Court in Abuja to enforce the judgment of the Supreme Court delivered by Justice Muhammadu Uwais which indicted Usman Al-Bashir of fraud alongside his companies in the receivership of West African Breweries Ltd.

In the South-East, the political temperature has shifted to Imo State West Senatorial District where Justice Kafarati had nullified the selection of Chief Hope Uzodinma as the winner of the PDP primaries.

The court premised its order on the grounds that he had been disqualified by the party’s screening committee to participate in the election.

Senator Izunaso had through his lawyer, Mr. Patrick Ikwueto (SAN), gone to the court after the PDP primary election for the senatorial district in which he came second to challenge the declaration of Uzodinma as the PDP’s candidate in the elections.

The court said that Izunaso, who scored the highest number of votes among the eligible contestants in the primaries for Imo West Senatorial District was entitled to have his name submitted to INEC for the April National Assembly polls.

But Uzodinma has gone to the Court of Appeal to challenge the decision the lower court. The appellant in a notice of appeal filed by his lawyer, Mr. Paul Erokoro (SAN), is challenging the decision of the FHC on the grounds that it erred in law when it overruled his preliminary objection and assumed jurisdiction on the matter.

According to him, Justice Kafarati erred in law when he held that he (Uzodinma) was not properly cleared to contest the primaries when there was ample evidence before the court that he had been cleared.

He also contended that he was not served with the originating summons in the matter, adding that the jurisdiction of the court was not activated for non-service of the originating summons and that the suit was incompetent for non-compliance with Order 3 Rule of the Federal High Court rules.

A Federal High Court in Abuja also barred the PDP from submitting the name of Governor Sullivan Chime of Enugu State as its candidate for the forthcoming governorship election pending the determination of a suit challenging his nomination.

Justice Kafarati also granted an interim order restraining INEC from accepting or validating the governor’s name as the PDP flagbearer for the governorship election in Enugu state.

The development was sequel to an ex parte application argued by Mr. Alex Izinyon (SAN), the lawyer to a PDP governorship aspirant in the state, Mr. Anayo Onwegbu, and 38 others.

Justice Kafarati in a separate matter also issued an order restraining the PDP from nominating Clever Ikisikpo as its candidate for the Bayelsa East Senatorial District pending the determination of a suit filed by Senator Amange Nimi-Barigha.

The judge also restrained the PDP in the interim, from submitting any other name other than that of the plaintiff to INEC as its candidate for the Bayelsa East Senatorial District for the National Assembly election.

In Oyo State, Justice Jonathan Shakarho of the Federal High Court in Ibadan nullified the results of the PDP congresses held between December 29 and 31, 2010 and by implication, nullified the primaries, which produced Governor Adebayo Alao-Akala as the PDP governorship candidate. The court ruling was sequel to a motion ex parte filed by three governorship aspirants in the state – Hazeem Gbalorumi, Elder Wole Oyelese and Yekeen Adeojo and 34 others – seeking to restrain the PDP from sending the governor’s name and other candidates to INEC based on the results of the congress.

The plaintiffs had prayed the court to restrain the defendants including INEC, the party, the state party Chairman, Dejo Afolabi and Alao-Akala from organising a party congress.

Expectedly, the flurry of court cases threatening the 2011 elections have continued to elicit comments from the stakeholders including lawyers and leading bureaucrats.

A human rights activists and legal practitioner, Mr. Bamidele Aturu x-rays the situation from two diametrical opposites. To him, it shows very clearly a lack of elite consensus in Nigerian politics.

He said, “That politics is fractious and sectional in turn shows that the accumulation system is largely primitive. An aspect of this primitivism is that the ruling elite depend on the state for survival. There is really no capitalist class. They all are contractors or power peddlers who make a living only from the state. Thus, we see that the process of class formation is either inchoate when compared to the same process in the advanced capitalist nations or, perhaps more accurately, cannot but be stunted since the ruling elite here cannot really develop beyond its present state as it has no ‘foreign country’ to exploit.”

Aturu stated that the dependence on state resources for survival made competition for elective and public offices violent and primitive. He did not spare the leadership of the political parties, who he described as “political barons” and “mafia gangs” demanding allegiance from the members by force. He said, “Barons are not used to following due process. Imposition of spouses and children on parties, which pretend to be public institutions is bound to generate violent and legal conflicts. We should be thankful to God if all we get are just court cases and not more assassinations.”

Also a civil rights activist based in the United States, Mr. Smart Ajaja, said that the failure of leadership is evident in every aspect of the nation’s life, including corrupt judiciary and a legal system which impact negatively on the administration of justice.

He said, “Most judges and lawyers have thrown ethics to the wind in pursuit of inordinate schemes to make money, in this case from politicians who lavish stolen money on them.

“That is why you hear judges granting frivolous injunctions with reckless abandon or delivering bizarre judgments relying on fraudulent legal and judicial technicalities. These bad practices are expensive, despicable and above all, make a mockery of the judiciary and the administration of justice.

Therefore, the Nigerian judiciary and the legal system are in urgent need of a far-reaching reform now than ever before.”

Another lawyer, Dame Carol Ajie, however disagrees with Aturu. She believes that instead of settling electoral dispute through violence, the courts still remain the supreme instrument of peace. She said, rather than have politicians settle grievances with the piercing edge of cutting tools and daggers, the civil method would be the use of statute books and the law courts as embodied in the 1995 Constitution and the Electoral Act of 2010, as amended.

According to her, “It is right that the civil and human rights communities enjoin citizens to follow the law, to apply the constitution and to preserve the integrity of the electoral system.” She, however, adds a caveat: Court processes should not be abused, “As we witnessed recently when an Enugu State High Court judge removed the PDP Chairman, Dr. Okwesilieze Nwodo, from office and the following day, a different state High Court Judge in Anambra, re-instated him.” Judges and lawyers, she warned, must therefore refrain from “self-inflicting opprobrium in order to sustain the respect and dignity this arm of government so deserves, no matter the degree of alluring temptations.”

For the Director, Initiative for Public Analysis, Mr. Thompson Ayodele, the solution to the army of court cases is the implementation of the Justice Muhammadu Uwais-led Electoral Reform Committee which suggested that cases should be disposed of before the inauguration of winners. He said, “That way, endless litigation is curtailed. By and large, the court process ought to be faster in dispensing with electoral matters. Without that, politicians might try to do everything possible to be declared winner when they know they would spend almost their entire tenure for the position after much delay and endless adjournments.”

The President of the Nigerian Bar Association, Mr. Joseph Daudu (SAN), had warned that the nation’s legal system could collapse as a result of unnecessary emphasis on election cases”.

At the valedictory court session in honour of a retired justice of the Supreme Court, Justice Ikechi Ogbuagu, Daudu lamented the congestion of cases in the Court of Appeal and Supreme Court, which he regretted would be worsened by the pre-election and election cases. As a way forward, Daudu renewed the call for a constitutional court, which was rejected by the National Assembly during the constitution review exercise.

The NBA boss also criticised “excessive reliance on written submissions” by courts, which according to him, “kills advocacy; a stone cold document cannot inspire the kind of persuasion a good advocacy can produce.” He urged the Chief Justice of Nigeria, Justice Aloysius Katsina-Alu, to constitute the Administration of Justice Commission charged with the duty of supervising activities of key institutions of the justice sector.

Benin chief alleges assassination attempt

Every employee of Petroleum Product Monitoring Service knows Blaise Orubor as a man who is not afraid of doing extra work. This quality endeared him to the Chairman of the company, Chief Henry Omoridion.

So, when Orubor volunteered to drive Omoridion’s vehicle from Benin in Edo State to Lagos State when his driver was not available, most of the staff saw his gesture as a familiar thing. At the end of the day, suspected assassins opened fire on the vehicle at Ijebu Ode end of Benin-Ore Expressway and Orubor escaped death by a whisker. He however lost a finger.


Omoridion told PUNCH METRO that he was the target of the attack. He said that the assassins must have been monitoring his movement as he was returning to Lagos.

He said, “I have been receiving threats of all kinds; kidnapping and death threats to mention a few. That day I left Benin, where I went to participate in the Peoples Democratic Primaries in Igbanke, in Orhiomwon Local Government area of Edo State. I got into that vehicle, a Toyota Hilux, instead of my personal vehicle. That Toyota was just like an escort vehicle. On the way, I changed my mind and decided to take a flight. I alighted from the vehicle and took another car to the airport while the Hilux proceeded to Lagos.

“Obviously, the killers did not know that I changed my mind as that Hilux was attacked at Ijebu Ode.”

Omoridion appealed to the Federal Government to strengthen the security in the country so that criminal elements would not have opportunity to perpetrate their nefarious activities.

He also urged the government to order a probe into the threats against him, adding that he was sure that some politicians were after his life.

But the spokesman of the Ogun State Police Command, Mr. Muyiwa Adejobi, ruled out assassination, saying that the attack on Omoridion was merely a robbery-gone-wrong.

He said, “Armed robbers operated inside a filling station on January 9, 2011. After they finished their operation, they started shooting sporadically into the air in a desperate attempt to escape from the area and from the police. In the process, a Toyota Hilux was hit by a stray bullet.

“There was nothing like assassination in this matter. It was just a case of a stray bullet hitting a vehicle. By the way, the owner was not in that vehicle and the case was not reported to the police until January 17.”
